Terms and Conditions

Welcome to Afayo (“we,” “our,” or “us”). These Terms and Conditions (“Terms”) govern your use of the Afayo mobile application and services (“Platform”), which connect patients and healthcare providers (caregivers) for in-person healthcare services either at home or a designated facility.


By accessing or using the Platform, you agree to be bound by these Terms. If you do not agree, you may not use the Platform.

1. Nature of Services

Afayo is a technology platform that facilitates the connection between:
- Users/Patients seeking healthcare or caregiving services; and
- Independent Caregivers/Health Workers willing to provide such services.

We do not employ caregivers nor do we provide any medical, healthcare, or diagnostic services.

2. Eligibility

You must be at least 18 years old to use this Platform. By using the Platform, you represent and warrant that you meet these eligibility requirements.

3. Account Registration

Users and Caregivers must create an account and provide accurate, current, and complete information. You are solely responsible for your account security and activities conducted under it.

4. User Responsibilities

- You are responsible for selecting a caregiver based on your own judgment and discretion.
- You are responsible for confirming the caregiver's qualifications and suitability.
- You agree to behave respectfully and safely toward caregivers.

5. Caregiver Responsibilities

As a caregiver:
- You must hold valid practicing licenses, certifications, and/or qualifications as required by law.
- You are solely responsible for the services you provide and their compliance with applicable laws.
- You agree not to represent yourself as our employee, agent, or affiliate.

6. No Medical Advice or Supervision

Afayo is not a healthcare provider and does not provide medical advice, diagnosis, or treatment. All medical decisions and services are the responsibility of the caregiver and the user.

7. Limitation of Liability

To the maximum extent permitted by law, Afayo, its affiliates, directors, employees, or agents shall not be liable for:
- Any personal injury, death, property damage, or other harm resulting from your interaction with a caregiver or patient;
- Any errors, omissions, or misrepresentations by users or caregivers;
- Any illegal or unethical conduct by caregivers or patients;
- Any malpractice, negligence, or breach of duty by caregivers.

You understand and agree that you use the Platform at your own risk.

8. No Guarantee of Service

We make no guarantee regarding the availability, reliability, or quality of caregivers or services provided. We reserve the right to remove or suspend any caregiver or user for any reason, without notice.

9. Background Checks and Verification

While Afayo may conduct limited background checks or verification, we do not guarantee the accuracy, completeness, or timeliness of caregiver credentials or identities. Users are encouraged to conduct their own due diligence.

10. Payments and Fees

All payments are processed through the Platform. You agree to pay all fees associated with your use of services. Refunds are subject to our Cancellation & Refund Policy.

11. Indemnification (compensation for harm or loss)

You agree to indemnify, defend, and hold harmless Afayo, its directors, officers, and affiliates from any claims, damages, liabilities, costs, or expenses (including legal fees) arising out of:
- Your use or misuse of the Platform;
- Your interaction with any caregiver or patient;
- Your violation of these Terms or applicable law.

12. Intellectual Property

All content on the Platform, including logos, trademarks, and software, is owned by or licensed to Afayo. You may not copy, reproduce, or distribute any content without our prior written consent.

13. Prohibited Activities

You agree not to:

Use the App for unlawful purposes

Impersonate another person or entity

Introduce malicious software

Interfere with the App’s operation or security

14. Termination

We reserve the right to suspend or terminate your account for any reason, including violation of these Terms, illegal behavior, or misuse of the Platform.

15. Modifications

We may update or modify these Terms at any time. Continued use of the Platform after changes means you accept the updated Terms.

16. Disclaimers

The App is provided "as is" without warranties of any kind. We do not guarantee that the App will be error-free, secure, or always available.

17. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of Uganda. Any disputes shall be resolved through arbitration in Kampala, and you waive the right to participate in a class action.
